TERMS AND CONDITIONS

Federica Tilgher, owner of Sleeping Stars, London SW11 4ET UK (the Coach) agrees to provide consulting services for the parents who intend to buy a package focusing on the improvement of their child’s sleep (the Client).

Coach-Client Relationship 
Coach agrees to maintain the ethics and standards of behaviour established by the Holistic Sleep Coaching program and by the International Association of Sleep Consultants. Sleep coaches are independent practitioners with a duty of care to their clients. This duty of care exists whether or not a fee is paid. Upon providing her consultancy service, the Coach follows the following guidelines to ensure good care and good outcomes for the Client:
• Bonding is a priority
• Empowering parents
• Smart sleep goals
• Age and developmentally appropriate
• Follow clients up properly
• Evidence-based information
• Recognise health and other problems
The Client is solely responsible for creating and implementing his/her decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. 
The Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. The Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders and that coaching is not to be used as a substitute for other professional advice by medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed.
The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

Confidentiality
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by principles of confidentiality. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (d) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (e) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (f) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

Services and Fees
The Coach will provide a coaching package that includes:
BASIC PACKAGE £90
• One consultation of 60 minutes via phone call, skype, facetime or whatsapp video/audio call (choice of the Client) at the agreed time.

PERSONAL PACKAGE £190
• A pre-consultation sleep diary form that the Client will fill-in
• One consultation of 90 minutes, tailored on the information provided by the Client, aimed at discussing potential strategies to address sleep issues.
• Follow-up in the form of one further telephone call (30 minutes) within the first 10 days after the consultation

PREMIUM PACKAGE £350 
• A pre-consultation sleep diary form that the Client will fill-in
• One consultation of 90 minutes, tailored on the information provided by the Client, aimed at discussing potential strategies to address sleep issues.
• One full, written summary and sleep plan via email within 2 days of the consultation.
• Follow-up in the form of two further telephone calls (30 minutes each)  within the first 20 days after the consultation
• Unlimited texts/emails for a period of 14 days following the first consultation.
The first consultation might take place in person at an address within 2 miles from London SW11. (A home visit at any other address shall be specifically agreed upon and all the travel expenses paid by the client).
By entering into an agreement to consult, the Client agrees to pay the specified fee, discuss any concerns with the sleep coach in the first instance, and make every effort to carry out the sleep plan consistently as mutually agreed at the time of consultation.
The Client acknowledges that, by any means, it is possible to guarantee that their child will sleep through the night or that all the issues related to their child’s sleep will be resolved within a certain amount of days and they agree that the specified fee is due for the supply of information and specialist advice aimed at that direction.

ADDITIONAL SERVICES
It is an option of the Client to add additional services to the above packages. Any further support will have to be specifically agreed upon in written by both parties.
• Consultations of 30 minutes via phone or video call (after the first package): £30
• 1 week unlimited email or text support: £75
• 1 hour home visit: £90 + travel expenses (free within 2 miles from London SW11)
• Twins and Siblings extra support: 50% off
• Bedtime support (18:30-23:30): £200 (central London)
• Night support (18:30-6:30): £550 (central London)

Cancellation 
The Client agrees that it is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. The Coach will attempt in good faith to reschedule the missed meeting. The Coach reserves the right to bill Client for a missed meeting.

Record Retention  
The Client acknowledges that the Coach has disclosed his/her record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by the Coach in a format of the Coach’s choice (print or digital) for a period of 5 years.

Limited Liability
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. 

Entire Agreement
This document reflects the entire agreement between the Coach and the Client, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Coach and the Client. 

Dispute Resolution
If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and the Coach agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

Applicable Law
This Agreement shall be governed and construed in accordance with the laws of the United Kingdom without giving effect to any conflicts of laws provisions.
